City Council = Competency?

Anyone interested in addressing City Council tonight when they overturn the annexation ordinance?  They promised NO RISK, NO COST, all upside benefit. Turned out to be ALL RISK, ALL COST and NO upside benefit... 

Perhaps a question as to why the budget impact shows as ZERO?  Wouldn't it be a MINIMUM of $138,000?

Yard Sign Removal

THANK YOU to those of you who displayed yard/window signs for the NO campaign.

Signs must be removed by the end of the month. If you'd like help removing signs, please contact us at (928) 230-4491 or refugepac@hotmail.com. They can be recycled or kept as a souvenir.

Who knows, we may need them again in the future if the Aldridges decide to go back to the City "when the political climate is better" (their words, not ours).

Thank you

Thank you so much to our amazing team of supporters -- the VOTERS and Lake Havasu City Residents, the Desert Hills residents and The Refuge residents. 

Whether it was writing memos, pounding in yard signs, hanging door hangers, making phone calls, or simply talking to people while standing in line at the grocery store... each of you made a difference in helping get to spread the word.

When it appeared that the deck was stacked against us and maybe even started to feel that it could be detrimental to your business to "admit" you were opposed to the annexation, you stood firm and pushed back.

FRIVOLOUS LAWSUITS? BREAKING NEWS ON LEGAL FRONT

Today, Refuge property owners received the court's ruling that Aldridge's Motion for Summary Judgment (in the property owner lawsuit) has been DENIED.

Further, the Aldridge's motion to change the Temporary Restraining Order for use of the roads to PERMANENT status was placed on hold until the "ultimate issues in this case are resolved".

A court date of June 16th was set to hear the oral arguments relating to the property owner's Motion for Summary Judgment.

Did You Know #27 - There's Still Time to Vote!

We've heard from many of you that you either did not receive your ballot in the mail or you tossed your ballot, thinking that this vote didn't really matter to you personally. 

If you tossed your ballot, you can obtain a replacement at City Hall, 2330 McCulloch.

There is a secured box at City Hall where you can hand-deliver your signed ballot.  Ballots will be accepted until 7:00 p.m. on Tuesday, May 17th.  If you have not yet mailed yours, it's probably safer at this point to hand deliver it to that location.

Make sure your voice is heard!

Did You Know #26

The lawsuit against the City would GO AWAY if the NO vote prevails. It would simply become a moot point as the City would no longer have any involvement with The Refuge.

The lawsuits that would NOT be dropped are the suits between the Aldridges and the property owners -- separate from the City.

SETTING THE RECORD STRAIGHT

The Refuge Community Association is vigorously protecting its community against a predatory developer.  A claim has now been made by City Attorney, Paul Lenkowsky, that the Association is in violation of campaign finance laws.  Mr. Lenkowsky has disseminated this claim to the media, without waiting for a response from Association attorneys, to the newspapers in Lake Havasu and the general public, as if it were uncontested fact.  It is not fact, it is fiction. 

The Refuge Homeowners have been counseled from the beginning of this referendum campaign by one of the finest election law attorneys in Arizona, specializing in initiatives and referendums.  The Community Association is a non-profit corporation and is not collecting donations for this campaign.  They are not required to register as a political committee, as Mr. Lenkowsky asserts.  A letter will be sent to Mr. Lenkowsky responding to his erroneous claims.

Unfortunately, the Aldridges, a local newspaper and members of our City Council did not allow due process to occur before jumping to conclusions and broadcasting to the public that laws were broken.  This is a direct manipulation and campaign ploy to mislead the public during these final days of voting.

The Aldridges, the City Attorney, the City Council and the AZ Independent should be ashamed of using their public offices for campaign purposes.

Attached is an 8-minute video of Paul Gilbert, the homeowner's attorney, advising them back in February 2010 (before the annexation request) of their rights as homeowners.

There were obviously more than a "handful" of property owners applauding when the attorney told them that what the Aldridges were attempting to do was illegal.

Would It Be Any Different?

Would it be any different if City Council had just approved a complete zoning change that allowed the London Bridge golf course to be converted to an RV Park? Or a drag strip?

Do you think those homeowners would fight back?

Or would that just be "progress" for Lake Havasu?

Did you know that the City did not require the Aldridges to provide an insurance policy or bond to back up their promise to indemnify the City from any legal claims relative to this annexation?

If the Aldridges go bankrupt, what happens to the indemnification?

Who is left paying the bills?  TAXPAYERS????

And the real question is.... Why would the City do that?

This just came out from Havasu Video News -- it provides a succinct overview from both sides about the annexation issue.

Did You Know #23

Did you know that our local Havasu newspaper has "come out of the closet" with their bias about this Refuge Annexation?  It's been pretty clear in all of the reporting that has taken place over the last 18 months that this newspaper has slanted its stories in favor of the Aldridges and City Council.  But now they have openly come out with their statement of bias.

Last Sunday, the News-Herald printed an Editorial about the goodness of the Refuge Annexation and why it deserves a YES vote. (See: http://www.scribd.com/full/54751718?access_key=key-jomf3wrw6da9yddvv5j  ).

This was shortly after the paper announced that it would no longer print any "Letters to the Editor" on the issue of the annexation.  Many of the opponents of the annexation had letters in the queue that were never published, letters that met the 300 word deadline and had been verified for publication. But never quite "got there".  

So the newspaper chooses to silence the public, and then comes out with their own Editorial telling everyone how important a YES vote is. 

Biased? 

Then, yesterday, the News-Herald printed an article about the red-tagging of the tent that contained several incorrect statements made by Jerry Aldridge.  When the newspaper was contacted and informed of the inaccuracies, they refused to issue a retraction.  (See http://havasunews.com/articles/2011/05/05/news/doc4dc23046c74f5635281178.txt ).

Incorrect Statement #1: "Jerry Aldridge said the Fire Department’s measure of red-tagging the structure didn’t close the pavilion event tent down." Reality: The tent was closed for any occupancy other than contractors or sub-contractors.
Incorrect Statement #2: "Aldridge said he was aware of the approaching expiration date and didn’t schedule any events past the expiration date." Reality: There were, in fact, events scheduled.
Incorrect Statement #3: "Aldridge said Wednesday he doesn’t need the homeowner’s permission when it comes to a fire access road." Reality: Aldridge can create a fire road on his property, but would not have access to that road without the use of the private HOA roads.
Unbiased reporting?  Think again.  To find out what is really going on in our City, we have to do our own research since it is obvious that our local newspaper will not.

Did You Know #22

Did you know that there are currently 8 lawsuits between the Aldridges and the Refuge property owners (6 OF THE LAWSUITS INITIATED BY THE ALDRIDGES THEMSELVES!!!) and that doesn't even count the lawsuit that has been filed against the City of Lake Havasu!

The Aldridges said publicly that the "truth" is that there are really only THREE lawsuits. They must have forgotten that they personally sued all five of the HOA Board members AND THEIR SPOUSES for actions these Board members took to protect their own private gated community.

Does the City really want to get involved in this mess?

JUST SAY NO -- IT'S TOO RISKY!

BREAKING NEWS

Yesterday afternoon, a decision was made in AZ Apellate Court that will directly impact this annexation process.

The findings were:  If an annexation is approved but challenged judicially, the annexation does not go into effect until all relevant appeals have been ajudicated. 

What this means for the Refuge annexation is that regardless of the outcome of the vote, the 49 acres will remain in County jurisdiction until the court case against the City of Lake Havasu has been ajudicated.

IT'S TOO RISKY

There are 8 pending lawsuits on this issue, NOT TO MENTION the lawsuit against the City of Lake Havasu.

A "NO" vote takes the City out of this mess and the associated liability.

It's too risky.  Just Say No.

Did You Know #21

...The City claims there is no "conflict of interest" with the Mayor and this annexation, even though he rents office space from the Aldridges. So the Aldridges are the Mayor's LANDLORD and there is no conflict? 

Also, we have been told that the Mayor does the books for the Aldridges. So the Mayor does accounting for the Aldridges and there is no conflict? Really?

When we formally requested that the Mayor to recuse himself because of these connections, he refused.  And now the Mayor, along with other City Officials, are actively acting as campaign managers for this annexation. 

This just doesn't seem right, even in a small town like Havasu.
